Introduction

www.readybed.com (the Site) is operated by Worlds Apart Limited trading as ReadyBed (we and us).

Use of the Site is on the terms contained in this document (Terms of Use). If you do not agree to these Terms of Use, stop using the Site immediately. By accessing and using the Site you are indicating your acceptance to be bound by these Terms of Use. They are a legal agreement between you and us and can only be amended with our consent. They should be read in conjunction with any details provided on the Site about how the Site operates and the services which are available.

The supply of any products or services you order from the Site is subject to our Trading Terms contained in our Legal section.

We reserve the right to change these Terms of Use from time to time without prior notice by changing them on the Site.

Accessing the Site

We cannot guarantee that the Site will operate continuously or without interruptions or be error-free. You must not attempt to interfere with the proper working of the Site and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt the Site or any computer system, server, router or any other internet-connected device.

You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use the Site and is compatible with the Site. You also understand that we cannot and do not guarantee or warrant that any content of the Site will be free from infection, viruses and/or other code that has contaminating or destructive properties. There may also be times when the Site or certain features or parts of the Site become unavailable, whether on a scheduled or unscheduled basis. You agree that we will not be liable to you or to any third party for any withdrawal, modification, unavailability, suspension or discontinuance of the Site or any service available on or through the Site.

Using the Site

You must use the Site and the information available from the Site responsibly. No such information may be used for or in connection with any unlawful, immoral or anti-social purpose, or in a manner which is or may be damaging to our name or reputation.

You may only use this website in accordance with these Terms of Use and, in any event, for lawful and proper purposes which includes complying with all applicable laws, regulations and codes of practice within the UK or other jurisdiction from which you are accessing this website.

In particular, you agree that you will not:

post, transmit or disseminate any information on or via this website which is or may be harmful, obscene, defamatory or otherwise illegal;
use this website in a manner which causes or may cause an infringement of the rights of any other;
use this website or any of the information available from the website, including in any user generated content on the website, in connection with any unlawful, immoral or anti-social purpose or in a manner that is or may be damaging to our name or reputation;
use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of this website including but not limited to uploading or making available files containing corrupt data or viruses via whatever means;
deface, alter or interfere with the front end 'look and feel' of this website or the underlying software code;
take any action that imposes an unreasonable or disproportionately large load on this website or related infrastructure;
obtain or attempt to obtain unauthorised access, via whatever means, to any of our networks.

Without prejudice to any of our other rights (whether at law or otherwise) we reserve the right to deny you access to this website where we believes (in our absolute discretion) that you are in breach of any of these Terms of Use.

Accuracy of information

We will use reasonable endeavours to ensure that information on the Site is accurate, but commentary and other material posted on the Site are not intended to amount to advice or authority on which reliance should be placed. Except to the extent that our Trading Terms contained in our Legal section apply, we make no representation or warranty that any information is accurate, complete or up-to-date and, to the fullest extent permitted by law, we accept no liability for any loss or damage caused by any reliance placed on such information by you or anyone to whom you communicate such information.

If you find any inaccurate information on the Site please let us know and we will endeavour to correct it, where we agree, as soon as reasonably practicable.

Intellectual property rights

All content on the Site including but not limited to text, software, photographs and graphics is protected by copyright. We, or our licensors, own copyright and/or database rights in the selection, coordination, arrangement and enhancement of such content, as well as in the original content. Except as expressly set out in these Terms of Use, nothing in these Terms of Use or on the Site shall give you any rights in respect of any intellectual property owned by us or our licensors. You shall not assert or attempt to obtain any such rights and you shall not use, copy, reproduce, modify, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit, our name, trade marks, logos or other proprietary marks, or any of the content of the Site, in whole or in part, except as provided in these Terms of Use.

You may download information from the Site for your own personal non-commercial use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and, if applicable, that of the copyright owner. In the event of any permitted copying, redistribution or publication of copyright material, no changes in or deletion of author attribution, trade mark legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyright material.

The rights granted to you under these Terms of Use shall terminate immediately upon your breach of any of these Terms of Use.

User generated content

You are solely responsible for any content you submit to the Site and the consequences of posting or publishing it. In submitting content, you warrant that you own or have the necessary rights and permissions to use and authorize us to use all content. Further, you agree that you will not submit material that is subject to third party rights unless you have permission from the rightful owner to post the material and to grant us the licence referred to below.

For clarity, you retain all of your ownership rights in your content, but by submitting your content you hereby grant us a worldwide, non-exclusive, royalty-free, irrevocable licence to use, reproduce, distribute, prepare derivative works of and display you content in connection with the Site, including for promoting the Site.

We reserve the right, in our absolute discretion, to edit, remove or discard your content, if you or the content appears to us to be in breach of any provision or the spirit of these Terms of Use or to be bringing the Site or us into disrepute.

Links to this and other websites

We may provide hyperlinks from the Site to other internet sites which are operated by other organisations. We are not responsible for external websites that link to the Site or which are linked from it. That we include these hyperlinks does not imply any endorsement of the material on such sites or any association with their operators.

You may not link from another internet site to any page on the Site, without our prior written consent. Such consent will be subject to conditions, including without limitation the following:

the link is neither misleading nor deceptive and must fairly indicate the Site as the destination of the link;
you do not remove, distort or otherwise alter the size or appearance of our logo;
you do not create a frame or any other browser or border environment around the Site;
you do not in any way imply that we endorse any products or services other than our own;

Our liability

Although we hope the Site will be of interest to users (and except to the extent that our Trading Terms contained in our Legal section apply), we accept no liability and offer no warranties or conditions in relation to the Site or its content, to the fullest extent such liability can be excluded by law.

If you are a consumer and not a business user, we shall not be liable to you for any business losses and shall only be liable for any losses which are reasonably foreseeable.

If you are a business user, in no event shall we be liable to you for any indirect or consequential loss, loss of profit, revenue or goodwill arising from your use of, or inability to use, the Site or information on the Site. Except as provided in these Terms of Use, all terms implied by law are excluded.

We accept liability for death or personal injury caused by our negligence and responsibility for fraudulent misrepresentation and any other liability that cannot, under English law, be excluded.

Indemnity

You agree to indemnify us and our subsidiaries, affiliates, officers, agents and employees against all liabilities, claims and expenses that may arise from any breach of these Terms of Use by you or from any content you submit, post to or transmit through the Site, your use of the Site, your connection to the Site, or your violation of any rights of another.

Any formal legal notices should be sent to us at the address at the end of these Terms of Use by email and confirmed by post.

Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms of Use.

If any part of these Terms of Use is found to be unenforceable as a matter of law, all other parts of these Terms of Use shall be unaffected and shall remain in force.

You and we agree that English law applies to these Terms of Use and that any dispute between us regarding the Site or arising out of or in connection with these Terms of Use will only be dealt with by the English courts, unless you are resident in another part of the United Kingdom, in which case the applicable law of that part of the United Kingdom will apply and any dispute will be brought before the courts there.
